RealManage, LLC Illegal Resale Documents and Disclosures Fees – Class Action Investigation
Ahdoot Wolfson is investigating a potential class action lawsuit against property management company RealManage, LLC, following reports that RealManage and its partners may be charging inflated fees to prepare and deliver resale documents and disclosures in connection with a sale of property managed by RealManage.
Homeowners/sellers in a real estate transaction where the property is subject to an HOA to provide buyers with certain documents and disclosures prior to the close of escrow. In order for the owner/seller to provide the prospective buyer with the required documents, the association is obligated to furnish those documents to the seller upon the seller’s written request for the same. An association (or their management company) is allowed to charge a reasonable fee for reproducing and delivering the requested documents.
RealManage provides a platform to request and receive resale documents for property sales within communities managed by RealManage. Reports suggest that RealManage and its partners engaged in a scheme to increase the “cost” of providing resale documents by three times the going market rate. RealManage then passes that greatly inflated “cost” along with additional fees charged by RealManage on to tens of thousands of sellers in California.
Ahdoot Wolfson is investigating whether these reported practices violate California law.
