San Diego Fertility Center Facebook Pixel Data Sharing – Health Information Disclosure Class Action Investigation
Ahdoot Wolfson is investigating a class action lawsuit against San Diego Fertility Center (“SDFC”) based upon our investigation revealing and reports that it shares highly sensitive patient and potential patient medical information directly with Meta (formerly Facebook) without authorization.
The unauthorized data sharing occurs as a result of SDFC’s inclusion of the Facebook Tracking Pixel tool on its website. The Facebook Tracking Pixel tool is coding that uses “cookies” to track the activities of users on SDFC’s website, which can include specific searches for doctors by specialization, by medical conditions (e.g., fertility information), and other searches that are keyed to other sensitive medical information. This and other highly sensitive and protected health information is collected as “identifiers” during website use and sent to Facebook.
SDFC’s use of the Facebook Tracking Pixel tool to collect and transmit protected health information of current and potential patients may violate consumer protection and data privacy laws, including the California Invasion of Privacy Act and California Confidentiality of Medical Information Act.
