CooperSurgical Embryo Loss – Class Action Investigation

Ahdoot Wolfson is investigating reports relating to CooperSurgical, Inc.’s recall of its embryo culture solution that is used for in vitro fertilization (IVF). The defective solution reportedly was used in IVF procedures in the United States and killed CooperSurgical’s customers’ developing embryos.

Lawsuits against CooperSurgical about this issue arose in late 2023, alleging that the company sold defective culture media used to grow embryos during the IVF process, resulting in the loss of customers’ embryos. CooperSurgical subsequently recalled some of its embryo culture media, noting that there was a risk of “impaired embryo development.”

We understand that IVF is a process that comes with an inherent set of challenges for families that choose this course, and that customers of fertility services providers entrust those providers with their embryos. CooperSurgical’s reported failure to protect its customers’ embryos may violate various laws.
