Grok (SpaceXAI / xAI) Biometric Privacy – Class Action Investigation

Ahdoot & Wolfson is investigating a possible class action lawsuit involving Grok, the AI chatbot operated by SpaceXAI, formerly known as xAI. The investigation concerns allegations that Grok collected scans of facial geometry from photos uploaded for analysis, rating, editing, or transformation without providing the notice and obtaining the written consent required by the Illinois Biometric Information Privacy Act (BIPA).

BIPA generally requires covered companies to provide written notice and obtain informed written consent before collecting covered biometric identifiers or information. It also requires a publicly available policy governing the retention and destruction of such information.
Ahdoot & Wolfson is investigating whether Grok violated these requirements and whether Illinois residents who uploaded photos showing faces may have legal claims. BIPA provides statutory damages for certain violations, but eligibility for relief depends on the facts and applicable law.

If you live in Illinois and uploaded a photo showing a face to Grok for analysis, rating, editing, or transformation, contact Ahdoot & Wolfson for a free, confidential review of your potential legal rights. Complete the form below to share your experience. Submitting the form does not guarantee eligibility or compensation.
