Safeway Misleading “Buy-One-Get-One Free” Promotion – Class Action Investigation

Ahdoot Wolfson is investigating a recent lawsuit and reports suggesting that California-based grocery chain Safeway may be misrepresenting its “buy one get one free” or “BOGO” promotions. According to recent reports, Safeway will offer an item for regular sale at a certain price point (example: $5.00), but when it puts that same item on “buy one get one free” or “BOGO” promotion, it will increase the regular sale price of that item (for example, to $10.00) to cover the cost of the promotion and the “free” item. In reality, the “free” item is not really free at all, and consumers are paying an artificially inflated price on the first purchase to account for the discount on the second “free” item.

Safeway’s reported “buy one get one free” false promotion may violate consumer protection laws and Federal Trade Commission rules on offers of “free” items.
