Scripps Memorial Hospital La Jolla – Health Information Disclosure – Class Action Investigation
Ahdoot Wolfson is investigating a potential class action lawsuit against Scripps Memorial Hospital La Jolla (“Scripps”) based upon reports that it shares highly sensitive patient and potential patient medical information directly with Meta (formerly Facebook) without authorization.
The unauthorized data sharing occurs as a result of Scripps’ inclusion of the Facebook Tracking Pixel tool on its website. The Facebook Tracking Pixel tool is coding that uses “cookies” to track the activities of users on Scripps’ website, which can include specific searches for doctors by specialization, by medical conditions (e.g., HIV), and other searches that are keyed to other sensitive medical information. This and other highly sensitive and protected health information is collected as “identifiers” during website use and sent to Facebook.
Scripps’ conduct in allowing the use of the Facebook Tracking Pixel tool to collect and transmit protected health information of current and potential patients may violate consumer protection and data privacy laws, including the California Invasion of Privacy Act and California Confidentiality of Medical Information Act.
